13、甲方应按国家和省、市的有关 规定给予乙方享受医疗期和医疗期待遇。Where Party B has contracted an illness or sustained a non-work-related injury, Party A should give Party 6B medical treatment and medical leave accordance with National or provincial regulation.3 乙方患职业病、因工负伤的,甲方按 中华人民共和国职业病防治法、工伤保险条例等有关法律法规的规定执行。Where Party B has con
14、tracted an occupational diseases or industrial injury, party A have to implement related provisions according to the “occupation disease prevention law“, industrial injury insurance regulations“ and other relevant laws and regulations.4 甲方为乙方提供以下福利待遇party A provides the following benefits for party
15、B 。6、劳动保护、劳动条件和职业危害防护Article 6 Labor Protection, Working Conditions and Protections against Occupational Hazards1 甲方按照国家和省、市有关劳动保护规 定,提供符合国家安全卫生标准的劳动作业场所和必要的劳动防护用品,切实保护乙方在生产工作中的安全和健康。Party A shall give Party B education and training programs relating to labor safety, professional skills and labor di
16、sciplines etc. According to the requirements of state labor protection and safe-production, Party A shall provide necessary working condition to ensure Party Bs safety and health.2 甲方按照国家和省、市有关规定,做好女 员工和未成年工的特殊劳动保护工作。Party A must conscientiously carry out relevant provisions formulated by the state
17、for the protection of female and under-aged employees.3 乙方从事 作业,可能产生 职业危害,甲7方应采取 防护措施, 且按照国务院卫生行政部门的规定组织上岗前、在岗期间和离岗时的职业健康检查,并将检查结果如实告知乙方。职业健康检查费用由用人单位承担。The Employee is engaged in the , possible occupation hazard, Employer should take protective measures, and in accordance with the health administra

19、门举报。The Employee must strictly abide by rules of safe operations during working process, and has the right to refuse peccant command and the right to demand correction or report to the relevant departments.7、规章制度Article 7 Regulation and Rules1 甲方依法制定的规章制度,应当告知乙方。Party A draw the regulation and rules
20、 up accordance to law and shall inform Party B.2 乙方应遵守国家和省、市有关法律法 规和甲方依法制定的规章制度,按时完成工作任务,提高职业技能,遵守安全操作规程和职业道德。8Party B shall obey the related Law and the Regulation which is draw up by Party A; to complete task on time, comply with the safety rules and occupation moral.3 乙方自觉遵守国家和省、市计划生育的有关 规定。Party
21、 B shall comply with the Family Planning regulation accordance to the Law.8、劳动合同变更Article 8 Alternation of Contract甲乙双方经协商一致,可以变更劳动合同。变更劳动合同应采用书面形式。变更后的劳动合同文本双方各执一份。Both of Party A and Party B reach a consensus on alteration of contract, which shall be in written form. Both parties shall keep a copy
22、 of revised contract.9、劳动合同解除和终止Article 9 Dissolution and Termination of Contract1 甲乙双方协商一致,可以解除劳动合同。Where Party A and Party B reach a consensus, the contract can be terminated.2 乙方提前三十日以书面形式通知甲方,可以解除 劳动合同;乙方试用期内提前三日通知甲方,可以解除劳动合同。To terminate the contract, Party B shall inform Party A in written not

Party B in three days advance notice to Party A in probation period.93 甲方有下列情形之一的,乙方可以通知甲方解除 劳动同: In any of the following circumstances, Party B may notify Party A to terminate this contract1 未按照劳动合同约 定提供劳动保护或者劳动条件的;Failure on the part of Party A to provide working cond
24、itions as agreed upon this contract.2 未及时足额支付劳动报 酬的; Failure on the part of Party A to pay labour remuneration.3 未依法为乙方缴纳 社会保险费,经乙方要求甲方缴纳,超过一个月仍未缴纳的;Party B shall pay social insurance premiums fall short of legal provisions, Party B request Party A to pay, not pay more than a month;4 规章制度违反法律、法 规的规定
25、,损害乙方权益的;Bylaw violates the legal provisions 5 以欺诈、胁迫的手段或者乘人之危,使乙方在违背真实意思的情况下订立或者变更本劳动合同,致使劳动合同无效的;By means of fraud and intimidation or position of vulnerability, so that Party B conclude or change the labor contract in violation of the true meaning of the case, the labor contract is invalid;6、免除自己
26、的法定责任、排除乙方权利,致使劳动合同无效的;Escaping their own legal responsibilities and eliminating Party Bs rights lead to the labor contract invalid;7、违反法律、行政法规强制性规定,致使劳动合同无效的;In violation of laws, administrative regulations of the mandatory provisions,the labor contract is 10invalid;8、法律、行政法规规定乙方可以解除劳动合同的其他情形。Legal
27、 and administrative regulations, Party B may terminate the labor contract situation.(四)甲方以暴力、威胁或者非法限制人身自由的手段强迫乙方劳动的,或者甲方违章指挥、强令冒险作业危及乙方人身安全的,乙方可以立即解除劳动合同,不需事先告知甲方。Party A forces Party B to work by violence, threat or illegal limitations of Party Bs freedom or Party A forces Party B to work by means
28、of force, threat or illegal restriction of personal freedom. Party B may notify Party A of terminating the contract at any time.5 乙方有下列情形之一的,甲方可以解除 劳动合同:The Company may dismiss the Employee at any time without further notice if the Employee: 1 在试用期间被证明不符合 录用条件的;Is proven to be incompetent for the em
29、ploying requirement during his/her period of probation;2 严重违反甲方的规 章制度的;Seriously breach labor disciplines or regulations as stipulated by the Company3 严重失职,营私舞弊, 给甲方造成重大损害的;Seriously neglects his duty and engages in malpractices for selfish ends, thuscausing significant harm to the interests of the
30、Company.4 同时与其他用人单 位建立劳动关系,对完成本单位的工作任务造成严重影响,或者经甲方提出,拒不改正的;Party B holds another job without the permit of Party A, which seriously affects the completion of Party As work task, or Party B refuses to correct the error after Party As warning;5 以欺诈、胁迫的手段或者乘人之危,使甲方在违背真实意思的11情况下订立或者变更本劳动合同,致使劳动合同无效的;By
31、means of fraud and intimidation or position of vulnerability, so that Party A conclude or change the labor contract in violation of the true meaning of the case, the labor contract is invalid; 6、被依法追究刑事责任的。Is found guilty according to the laws of P.R.C.6 有下列情形之一的,甲方提前三十日以 书面形式通知乙方或者额外支付乙方一个月工资后,可以解除
32、劳动合同, 劳动合同法第四十二条规定的情形除外: In any of the following circumstances, Party A may terminate this Contract upon prior written notice of thirty (30) days to Party B or one month salary in lieu of the notice,expect forty-second Labor Law of the Peoples Republic of China:1 乙方患病或者非因工 负伤,在规定的医疗期满后不能从事原工作,也不能从事由
33、甲方另行安排的工作的; Party B, due to sickness or injury inflicted off the job, can not resume his or her work or do the other job reassigned by Party A after specified period of medical treatment; 2 乙方不能胜任工作, 经过培训或者调整工作岗位,仍不能胜任工作的;Party B is unqualified, even after a training or job adjustment.3 劳动合同订立时所依据的客
34、 观情况发生重大变化,致使劳动合同无法履行,经甲乙双方协商,未能就变更劳动合同内容达成协议的。 12The objective conditions on which the contract is based have materially changed to the extent that it is impossible to perform the contract while both parties cannot reach an agreement to amend the contract to reflect the changed conditions.7 有下列情形之一
35、,甲方需要裁减人员 二十人以上或者裁减不足二十人但占甲方职工总数百分之十以上的,甲方应提前三十日向工会或者全体职工说明情况,在听取工会或者职工的意见,并将裁减人员方案向人力资源保障(劳动)部门报告后,可以裁减人员, 劳动合同法第四十二条规定的情形除外:One of the following circumstances,Party A would require reductions in staff of 20 people or more reduction of less than 20 but accounts for more than 10 per cent of the tota

38、n or Operation mode adjustment.After amendment of employment contracts , still needs to reduce its workforce;4、其他因劳动合同订立时所依据的客观经济情况发生重大变化,致使劳动合同无法履行的。 The basis for the conclusion of the contract has greatly changed so that the contract can no longer be carried out,while both parties cannot reach an
39、 agreement on modifying the contract by mutual negotiation.8 有下列情形之一的,劳动合同终止:The contract will terminate in case any of the following occurs:1、劳动合同期满的;The labor contract expires;2 乙方达到法定退休年 龄的;Party B shall reach the statutory retirement age;3、乙方死亡,或者被人民法院宣告死亡或者宣告失踪的;Party B is dead, pronounced dead
40、 or pronounced missing by the peoples court;4 甲方被依法宣告破 产的; Party A is declared bankruptcy legally;5 甲方被吊销营业执 照、责令关闭、撤销或者甲方决定提前解散的; Party As business license is revoked; Party A is compelled to close down or dissolve; or Party A decides to dissolve in advance6 法律、行政法规规 定的其他情形。Other situations stipula
41、ted in laws and administrative provisions10、经济补偿Article 10:Economic compensation141 符合下列情形之一的,甲方应当向乙方支付 经济补偿: Party A shall pay economic compensation to Party B in follow case;1、甲方依据本劳动合同第九条第(一)项规定向乙方提出解除劳动合同并与乙方协商一致解除劳动合同的;Party A to Party B in accordance with the labor contract in Article 9 ( a )
42、the provisions of proposed dissolution of the labor contract , and in consultation with the Party B agreed to terminate the labor contract; 2 乙方依据本劳动合同第九条第(三) 项、第(四)项规定解除劳动合同的;Party B in accordance with the labor contract in Article 9 (3) or paragraph (4) provides labor contract is terminated ; 3 甲方
43、依据本劳动合同第九条第(六) 项、第(七)项规定解除劳动合同的;Party A according to the labor contract of article 9 ( 6 ) , the provisions of paragraph ( 7) of the labor contract is terminated;4 除甲方维持或者提高 劳动合同约定条件续订劳动合同,乙方不同意续订的情形外,依据本合同第九条第(八)项第1目规定终止固定期限劳动合同的;In addition to party a to maintain or improve the condition of the la
