1、公积金配套文件二SPF Supplementary Document 2苏州工业园区公积金转移管理规定SPF Transfers Management Regulations第一章 总 则Chapter One General Provisions第一条 为了加强和规范苏州工业园区（以下简称园区）公积金社会保障关系转移管理工作，根据苏州工业园区公积金管理暂行办法和苏州工业园区公积金管理暂行办法补充规定（试行） ，制定本规定。Article One In order to strengthen and standardize the management of transferring SPF
2、social insurance relations, SPF Transfers Management Regulations is hereby formulated in accordance with Interim Measures for SPF Management and Regulations Supplementary to Interim Measures for SPF Management (Trial). 第二条 园区公积金管理中心（以下简称“中心” ）负责园区公积金关系转移和社会关系转移的管理工作。Article Two SPF Management Center
3、 (shortened Center as below) is responsible for the management of SPF transfers and the transfers of social relations.第三条 园区公积金制度设 A、B、C 三类综合的社会保障计划。Article Three Three comprehensive social insurance programs are designed in the SPF System as A, B, C represented.（一）A 类综合保障计划（以下简称 A 计划）：含员工基本养老、医疗、失业
4、、工伤、生育保险和住房保障等六项社会保障内容，个人账户分设养老、医疗、普通三个专户。Clause One A-type Comprehensive Social Insurance Program (shortened Program A as below) includes six items, such as employees basic retirement insurance, medical insurance, insurance against unemployment, work-related injuries and housing insurance etc.; pen
5、sion account, medical care account and ordinary account are opened under each personal account separately.（二）B 类综合保障计划（以下简称 B 计划）：含员工基本养老、医疗、失业、工伤和生育等五项社会保障内容，个人账户分设养老、医疗、特别三个专户。Clause Two B-type Comprehensive Social Insurance Program (shortened Program B as below) includes five items: employees bas
6、ic retirement insurance, medical insurance, insurance against unemployment, work-related injuries and reproduction; pension account, medical care account and special account are opened under each personal account separately.（三）C 类综合保障计划（以下简称 C 计划）：含员工基本养老、失业、工伤、大病住院医疗等四项社会保障内容，个人账户分设养老、特别两个专户。Clause
7、 Three C-type Comprehensive Social Insurance Program (shortened Program C as below) includes four items: employees basic retirement insurance, medical insurance, insurance against unemployment, work-related injuries and major hospitalization. Pension account and special account are opened under each
8、 personal account separately.第二章 园区内公积金转移Chapter Two SPF Transfers within Suzhou Industrial Park第四条 会员在园区范围内就业岗位流动，须由用人单位（聘用方）为该会员办理公积金关系转移手续。未办理公积金关系转移手续的，该会员公积金个人账户将予以封存。Article Four When SPF members change working posts within Suzhou Industrial Park, their employers shall finish SPF transfers for
9、malities; otherwise, without finishing the SPF transfers formalities, members SPF account will be closed.第五条 会员在园区公积金同类综合社会保障计划之间转移，其个人账户各专户不作调整。Article Five If members SPF is transferred within social insurance programs of the same kind, their personal account will not be adjusted.第六条 会员从 A 计划向 B 计
10、划转移，保留养老专户和医疗专户，取消普通专户，另设特别专户。Article Six When a members SPF is transferred from Program A to Program B, his pension account and medical care account will be maintained, whereas special account will be opened in substitute for ordinary account.转移时，按该会员历年缴费基数，B 计划养老专户、特别专户入账比例和应计利息，计算转移金额。计算所得金额，分别计入
11、其 B 计划的养老专户、特别专户。原 A 计划下养老、普通专户合计金额在转移后如有余额计入其特别专户；转移金额不足的，须由其本人用现金补足差额后方可办理转移手续。医疗专户余额不作调整。When a members SPF is transferred, the amount of money to be transferred shall be calculated according to the basis of his annual payment, the ratio of money into his pension account to that into his special
12、account in Program B as well as the interest rate to be included. The amount of money receivable shall enter into his pension account and special account in Program B. If his previous pension and ordinary accounts in Program A, after transferred, still have the balance, the remaining sum of money sh
13、ould enter into his special account. If the amount of money to be transferred is not adequate, he has to make up the balance; otherwise, he is not allowed to go through transferring formalities. The balance in his medical care account will not be adjusted.第七条 会员从 A 计划向 C 计划转移，保留养老专户，取消普通专户，另设特别专户，并封
14、存医疗专户（医疗专户如有余额的，可按规定继续使用） 。Article Seven When a members SPF is transferred from Program A to Program C, his pension account will be maintained, whereas special account will be opened in substitute for ordinary account. Besides, his medical care account will be closed ( if the balance remains in his
15、medical care account, the remaining sum of money can be spent according to regulations).会员养老专户，特别专户转入金额的计算同本规定第六条办法。The calculation of the amount of money to be transferred into his pension account and special account is the same with the measure stipulated in Article Six.第八条 会员从 B 计划向 A 计划转移，保留养老专户
16、和医疗专户，取消特别专户，另设普通专户。Article Eight When a members SPF is transferred from Program B to Program A, his pension and medical care accounts will be maintained, whereas ordinary account will be created in substitute for special account. 会员原 B 计划下养老专户、特别专户的存储额，分别转入 A 计划养老专户，普通专户内。The savings on his pension
17、 and special accounts in Program B should be transferred into his pension account and ordinary account respectively.第九条 会员从 B 计划向 C 计划转移，保留养老专户和特别专户，封存医疗专户（医疗专户如有余额的，可按规定继续使用） 。各专户存储额不作调整。Article Nine When a members SPF is transferred from Program B to Program C, his pension and special accounts wil
18、l be maintained, his medical care account will be closed ( if the balance remains in his medical care account, the remaining sum of money can be spent according to regulations). The savings in each account will not be adjusted.第十条 会员从 C 计划向 A 计划转移，保留养老专户，取消特别专户，另设医疗专户和普通专户。Article Ten When a members
19、 SPF is transferred from Program C to Program A, his pension will be maintained, whereas medical care and ordinary accounts will be created in substitute for special account.会员原 C 计划下养老专户、特别专户存储额分别转入 A 计划下养老专户、普通专户内。The savings on his pension and special accounts in Program C should enter into his p
20、ension and ordinary accounts respectively in Program A.第十一条 会员从 C 计划向 B 计划转移，保留养老专户和特别专户，另设医疗专户。各专户存储额不作调整。Article Eleven When a members SPF is transferred from Program C to Program B, his pension and special accounts will be maintained, and medical care account will be created. The savings in each
21、account will be not adjusted.第十二条 会员在园区公积金与园区农村基本养老保险制度间（以下简称农保）转移，须办理关系转移手续。会员从园区公积金向园区农保转移，公积金个人账户封存，另设农保个人账户。园区农保参保对象从农保向园区公积金转移，另设公积金个人账户，其农保个人账户予以封存。Article Twelve When a members social insurance relationship is transferred between SPF and the retirement insurance system in the rural area of Su
22、zhou Industrial Park (shortened rural insurance in the below), transferring formalities should be finished. When a members SPF is transferred to rural insurance, a new rural insurance account should be created, whereas his SPF account should be closed. When a members rural insurance is transferred t
23、o his SPF, a new SPF account should be created, whereas his rural insurance account should be closed.第三章 区外社会保障关系转入Chapter Three Transfers of Social Insurance Relationship From outside Suzhou Industrial Park第十三条 会员从园区行政区域外社会保险统筹地区用人单位向园区用人单位流动，应办理社会保险关系转移手续。会员参加园区外住房公积金制度的，视其本人参加公积金社会保障计划类型，可办理住房公积金
24、基金转移手续。Article Thirteen When a member withdraws from the employer subject to social insurance outside Suzhou Industrial Park and is employed by the companies within Suzhou Industrial Park, he should go through the formalities of transferring social insurance relationship. If a member joins in the ho
25、using provident fund program outside Suzhou Industrial Park, he should go through the formalities of transferring housing provident fund account, according to what type of SPF program he joins in.第十四条 会员从江苏省内社会保险统筹地区（以下简称“省内” ）用人单位转入的，社会保险关系及住房公积金基金转移按如下规定办理：Article Fourteen When a member withdraws
26、from the employer within social insurance system of Jiangsu province, the transfers of social insurance relationship and housing provident fund should be processed according to the following regulations:（一）基本养老保险办理关系转移手续，基本养老保险个人账户记账存款额不作转入。Clause One With regarding to going through the formalities
27、of transferring basic retirement insurance, the bookkeeping saving on his pension account should not be transferred.（二）基本医疗保险办理关系转移手续，基本医疗保险个人账户存款，可视转出地社会保险有关政策的规定，及本人参与的公积金社会保障计划类型作相应的转入。转入的个人账户存款额，计入其本人公积金医疗专户内。Clause Two As for going through the formalities of transferring basic medical care insu
28、rance, the savings on his medical care account should be transferred correspondingly referring to relevant policies of social insurance of the place he comes from and what type of social insurance program he joins in. The savings to be transferred to his personal account should enter into his medica
29、l care account.（三）区外住房公积金基金办理转入手续，住房公积金个人账户存款，视会员参加的公积金社会保障计划类型，转入其本人公积金普通专户内。Clause Three As for going through the formalities of housing provident fund, the savings on his housing provident fund account should be transferred to his SPF ordinary account referring to what type of SPF program he join
30、s in.第十五条 会员从江苏省外社会保险统筹地区（以下简称省外）用人单位向园区用人单位流动的，社会保障关系及住房公积金基金转移按如下规定办理：Article Fifteen When a member withdraws from the employer subject to social insurance system outside Jiangsu province, the transfers of social insurance relationship and housing provident fund should be processed according to th
31、e following regulations:（一） 基本养老保险需同时办理关系转移及个人账户存款额转入手续。转入的个人账户存款额计入其本人公积金养老专户内。Clause One As for basic retirement insurance, he should go through the formalities of transferring social insurance relationship and the savings on his account. The savings to be transferred should enter into his pension
32、 account.转入的基本养老保险基金为：1997 年 12 月 31 日前基本养老保险个人账户中个人缴纳部分累计储存额；以及 1998 年 1 月 1 日后基本养老保险个人账户的全部储存额。Basic retirement insurance fund includes the accumulated sum the member pays himself before December 31,1997 and the total savings on his personal account after Jan.1,1998.基本医疗保险关系转移及住房公积金基金转移，同本规定第十四条（二
33、） （三）款。The transfers of basic medical care insurance and housing provident fund is the same with Clasuse Two and Clause Three as stipulated in the Article Fourteen.第十六条 会员从园区外转入的基本养老保险个人账户存款以及住房公积金个人账户存款，基本医疗保险个人账户存款，于转入后的下一结息期起，按园区公积金个人账户存款利率按年计算利息。Article Sixteen Since the next interest settlement
34、 date as of the transfers, the interest of his savings on his pension account, housing provident fund account and medical care account, are all calculated according to the interest rate of SPF personal account.第四章 区内公积金向区外转移Chapter Four SPF Transfers to the Outside第十七条 会员从园区用人单位向省内社会保险统筹地区用人单位流动，应办理
35、公积金社会保险关系转移手续。会员参加公积金 A 计划的，可同时办理住房公积金基金转移手续。社会保险关系及住房公积金基金转移按如下规定办理：Article Seventeen When a member withdraws from the companies within Suzhou Industrial Park, and is employed by the employer subject to social insurance of Jiangsu Province, he should go through the formalities of transferring socia
36、l insurance relationship. If he is the member of Program A, he can, meanwhile, go through the formalities of transferring housing provident fund account. Social insurance relationship as well as housing provident fund account should be transferred according to the following regulations:（一）基本养老保险关系转移
37、。根据会员公积金每月交缴额推算基本养老保险缴费基数，按苏州市基本养老保险社会统筹及个人账户入账比例，计算基本养老保险社会统筹基金及个人账户的本息和。计算所得的总额，扣除已入账的公积金社会统筹基金额后，从其本人公积金养老转户、普通专户中抵扣，然后办理基本养老保险关系转出手续。Clause One Transfer of Basic Retirement Insurance Relationship. The total sum of money and its interest on the personal account and the pool of money accumulated f
38、rom social insurance should be calculated according to the members monthly payment as the basis, and the ratio of the money into the pool to that into the personal account. The sum, excluding the receivable into the pool, should be deducted from his pension and ordinary accounts. Then, basic retirem
39、ent insurance relationship can be transferred.（二）基本医疗保险关系转移。参加 A、B 计划的会员公积金医疗专户存款，可视转入地区社会保险有关政策的规定，作相应的转移。Clause Two Transfer of Basic Medical Care Insurance Relationship. The savings on members medical care accounts of Program A or B, can be transferred correspondingly referring to regulations in
40、relevant policies of social insurance in the place where he works.（三）住房公积金基金转移。参加 A 计划的会员办理住房公积金转移所需的转移金额，按苏州市住房公积金缴纳比例推算。转移所需金额从其公积金普通专户存款中抵扣。Clause Three Transfer of Housing Provident Fund Account. The needed sum of money for transfering members housing provident fund account in Program A should b
41、e deducted from his ordinary account according to the proportion of payments to Suzhou Housing Provident Fund.（四）参加 A 计划的会员，因动用普通专户存款购房，在办理基本养老保险关系转移时，其普通专户存款额不足抵扣的，不足部分应由其本人用现金补足后，方可办理基本养老保险关系转移手续。Clause Four If a members ordinary account, which has been drawn to purchase his house, is not enough t
42、o be met, when transferring his basic retirement insurance, he should make up the balance so that he is allowed to go through the formalities of basic retirement insurance relationship.第十八条 会员从园区用人单位向省外用人单位流动，在按规定第十七条相应的规定办理转移手续后，还应按第十七条（一）款规定，将推算所得的基本养老保险个人账户存款额同时转出。Article Eighteen When a member w
43、ithdraws from the companies within Suzhou Industrial Park, and is employed by the employer outside Jiangsu Province, the transferring formalities can be processed according Article Seventeen, and the sum of money calculated on his pension account should be transferred meanwhile according to Clause O
44、ne in Article Seventeen.第十九条 会员按第十七条、第十八条规定办理社会保险关系及（或）住房公积金基金转移手续后，个人账户仍有余额的，应予暂时封存。符合苏州工业园区公积金专户管理规定第二十三条、第二十四条、第二十五条的有关规定，经批准后，可一次性提取其个人账户封存的本息。Article Nighteen If a members personal account still has the balance, when his social insurance relationship and (or) housing provident fund account are
45、transferred, his account should be closed. In compliance with Article Twenty-three, Article Twenty-four and Article Twenty-five in Regulations of Managing SPF Accounts, the sum of money and its interest can be lump-sum drawn upon the approval. 第五章 附 则Chapter Five Supplementary Provisions第二十条 用人单位及会员
46、欠缴公积金的，须补缴后方可办理园区公积金、社会保险关系及住房公积金基金转移手续。Article Twenty If the employ or the member does not pay off the money owed to SPF, SPF, social insurance relationship and housing provident fund account can not be transferred only if they compensate the owed money.第二十一条 本规定由园区公积金行政主管部门负责解释Article Twenty-one The Administrative Competent Agency of Suzhou Industrial Park is responsible for interpretating these regulations.第二十二条 本规定自二零零四年一月一日起施行。Article Twenty-two These regulations take effect as of January 1, 2004.
