2、ore, Owings costs pertaining to building materials and systems; contracting procedures; construction cost estimates to confirm design compliance with the construction cost budget and necessary value engineering and construction planning required for appropriate development of the design documents by
3、 the design team. The above advice will be provided based on alternative building materials and systems which will be submitted by Party B while providing Party Bs Basic Services for the Project. Party A will also prepare project schedules and confirm compliance with the design schedule and construc
4、tion schedules. 2.8 有关本项目的设计进度表请参照附件B。 For the agreed project design schedule refer to Exhibit B. 2.9 本设计合同服务根据甲方要求严格控制成本。乙方应及时将有关设计资料提供给甲方，甲方安排专业人员在设计的不同阶段，及时对预算控制提出专业意见。乙方应对上述意见给予充分重视，在双方协商的基础上完成设计成果。 In this contract, Party A requires close control of construction costs. Party B will provide desi
5、gn information to Party A in a timely fashion so that Party A will provide ongoing cost estimate control comments to Party B in a timely fashion. Party B will consider these comments and complete the design scheme based on the comments agreed by both parties. 3 基本服务范围 SCOPE OF BASIC SERVICES 3.1.1 乙
6、方所提供的基本的建筑、结构、市政工程、机电工程、设备和给排水各专业的设计顾问服务定义如下： Party B will provide Basic Architectural, Structural, Civil and MEP Design Consulting Services with the following definitions: 8(i) “基本建筑” 是指核心筒和壳体部分。壳体将包括结构系统，建筑物的外墙设计；核心筒包括电梯、消防楼梯、管道竖井、电气及电话间和厕所。采暖通风及空调设备和电气设备用房、主要垂直及水平方向分配系统。货物装卸区，地下层停车场及建筑管理服务用房。设置于顶
7、层的电梯和机器设备室。主要公共空间的室内设计和场地园林绿化设计工程。 “Base Building” shall consist of the shell and core portions of the building (s) and shall include: the structural system: the exterior building envelope; the core elements containing the elevators, exit stairs, duct and pipe shafts, telephone and electrical closet
8、s and toilet room: the mechanical/electrical equipment areas and the vertical and horizontal distribution of the Primary mechanical/electrical systems: truck docks and service areas: basement levels used for parking and building services: elevator and mechanical equipment penthouses: finished public
9、 areas; and the site development and landscape design work. (ii) 基本建筑将不包括租户要求的改善工作，单元内的室内装修、固定及活动家具、装置和设备。合同范围以外的技术基础设施项目也不包括在内 。 “Base Building” excludes all tenant improvement work; all interior finishes in the tenants units, fixtures, furnishings and equipment; and all infrastructure components o
10、utside the contract limits. 3.2 概念设计阶段的服务 Conceptual Design Services 根据业主方的具体设计要求，通过不同的概念设计思路讨论本项目的特征以及本项 目与周边其他已开发或将要开发项目的关系，探讨建筑基本外形和轮廓，核心筒的可行性布置、各空间的相互关系、交通和服务六县的组织，作为方案设计的基础。 Based on Clients program requirement, prepare alternative concepts to develop the character of the project and its relati
11、onship to the existing and future projects in the surrounding area. These alternative concepts shall address prototypical massing, possible layouts of the core, relationships of the new development programs, and traffic/service circulation to serve as the basis of Schematic Design. 提交成果 Schematic De
12、sign Deliverables a. 设计说明、图纸、渲染图（三个不同视点）、工作模型。 Shall include design narratives, drawings, renderings of three different views, and study models. 9b. 图纸的基本内容包括： 规划指标说明、总平面图、场地设计平面图、交通流线示意图、环境设计图、色彩景观规划图、一层平面图、地下层平面和停车场布置图、屋顶平面图、东西南北四个建筑立面图、南北向剖面图、东西向剖面图、初步结构体系概念性草图、对于采暖通风、空调、给白水、电气系统设计的概念性说明、建筑面积一览表。
13、 Basic drawings shall include: Planning Economical Index , Master plan, site plan, traffic/circulation plan, ground level plan, basement level and parking level plan, roof plan, east, west, north and south elevations, north-south and east-west sections, initial conceptual sketches for proposed struc
14、tural systems, initial conceptual description for MEP system, and a tabulation of building areas. c. 以上文件的电子版本将上载於项目网站供甲方下载。 The electronic files of the above design documents shall be uploaded onto a project website for Party A to download. 3.2 方案设计阶段的服务 Schematic Design Services (i) 方案设计文件包括图纸，设计说
15、明和其它，以及制定本工程的基本范围和各组成部分的内在关系。可能有一些由甲方要求的渲染及模型不包括在乙方的估算之内。 Preparation of Schematic Design Documents included shall be schematic drawings, an outline description of the project and other documents which shall establish the general extent and scope of the project and the interrelationships of the proj
16、ect components, and, as may be authorized by Party A any renderings, and scale models beyond Party B estimate. 19、n, structure foundation plan, MEP systems concept, allocation of space requirement for system, load calculations and a tabulation of building areas. f. 乙方将提供方案设计的图纸深度样本。本设计服务将不低于乙方提供的样本深度。 Party B will provide a sample set of Schematic Design drawings to illustrate the level of detail to be provided
20、 for this project. g. 以上文件的电子版本将上载於项目网站供甲方下载。 The electronic files of the above design documents shall be uploaded onto a project website for Party A to download. (iii) 双方明确，在方案设计阶段，乙方将根据规划委员会的书面批复意见修改并完善方案设计。 It is understood that during the Schematic Design phase, Party B will incorporate the writ
21、ten comments from the city Planning department to complete the final schematic design. 3.3 初步设计阶段的服务 Design Development Services (i) 方案设计文件批准后，初步阶段的服务将进一步确定工程的尺寸大小、特征、主要建筑、结构系统、建筑材料及其它组成。它将包括初步设计图纸，设计说明。可能有一些由甲方要求的渲染图及模型不包括在我们的估算之内。 After approval of the Schematic Design Documents, preparation of De

Included shall be drawings, outline specifications, and, as may be authorized by Party A, any renderings and scale models beyon

24、面图、东西南北四个建筑立面图、外墙局部放大立面图、南北向剖面图、东西向剖面图、公共空间剖面图、外墙局部放大剖面图、局部放大核心筒平面图、大堂天花平面图、大堂铺地设计图、大堂接待台平立剖面图、电梯轿箱内部天花、地面和平立剖面图、室内公共门厅空间及_座报告厅各立面图、室内公共空间节点详图、首层外墙设计图、屋顶层外墙设计图、公共空间部分楼梯剖面图、防火通道剖面图、标准屋顶节点详图、建筑面积表、材料说明纲要、用以解释主要材料、设备的品种或档次、规格参数和其他技术要求。结构设计图（包括基础平面图、标准的基础剖面和详图、标准框架平面、剖面及详图）和表格（包括基础一览表、柱子一览表、标准结构梁一览表）及主要

27、oor plan, lobby desk plan, section, by contractors differing methods of determining bid prices; by the competitiveness of the bidding; by market conditions; and by other factors beyond Party Bs control, Party Bs assistances cannot guarantee that bids or construction costs will not vary from Party As
28、 estimates. 13.3 乙方的服务是专门对本合同的要求和甲方的利益，任何承包商、分包商、供应商、加工商、制造商、顾问或他第三方不能就本合同或乙方服务内容的执行与否向乙方提出索赔。 Party Bs services are being performed solely for Party As benefit and neither the contractor nor any subcontractor, supplier, fabricator, manufacturer, consultant or other third party shall have any claim
29、against Party B as a result of this contract or the performance or nonperformance of Party Bs services. 13.4 如果合同双方的任何一方因节假日而使工作暂停，必须提前7天通知另一方。 Shall there be holidays resulting in delay in project developments, either of the parties shall inform its counterpart seven days in advance. 13.5 本合同未经另一方书

McCarthy, Partner 14 争议解决 DISPUTE RESOLUTION 本合同各条款依据甲方所在地法律拟定，若甲乙双方在履行过程中发生争议，应及时协商解决，协商不成时，双方同意提交中国国际经济贸易仲裁委员会按照其仲裁规则在北京对争议做出仲裁。 Any disputes or disagreements arising under this Contract shall be resolved by
32、 mutual consensus of the both parties. In the event that mutual agreement fails to resolve any dispute or disagreement, both parties agree to utilize China International Economic and Trade Arbitration Board to initiate arbitration based on the rules and regulation established by the city of Beijing.
33、 2915 设计合同有效期 DESIGN CONTRACT VALIDITY 15.1 本设计合同自甲乙双方的法人代表或授权代表签定本设计合同当日生效。且甲方在设计合同生效后十日内付出项目定金, 乙方在收到定金后即开始基本服务。 This Design Contract becomes effective at the date of the signage executed by the legal representative or by the authorized legal representatives of Parties A and B. Party A will pay th
34、e Project retainer within 10 days after the effective date of the Design Contract, Party B shall commence its Basic Services following receipt of the mobilization payment. 15.2 本设计合同在甲乙双方完全履行本合同所定的各方义务及责任后失效。 This Design Contract becomes ineffective after the completion of rights and responsibilitie
35、s designated to the parties described in the document. 15.3 本设计合同一式六本，甲乙双方各持三本。 There will be one (1) version of this Design Contract with six (6) executed originals.
