2、ROCLAMATIONWHEREAS, it has become necessary to amend the Labour Proclamation No.377/2003;NOW, THEREFORE, in accordance with Sub Articles(1)and(3)of Article 55 of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows;1、 Short TitleThis Proclamation may be

3、 cited as the “Labour(Amendment) Proclaimed NO.494/2006”2、 AmendmentThe Labour Proclamation NO.377/2003 is hereby amended as follow:1/ The provision of (c) of Sub-Article 2 of Article 3 is deleted and replaced by new provision (c) of Sub-article 2 of Article 3“(c) managerial employee who is vested w

4、ith powers to pay down and execute management policies by law or by delegation of the employer depending on the type of activities of the undertaking with or without the aforementioned powers an individual who 宣告 NO.494/2006文告提供劳动公告的修订鉴于,2003 年第 377号劳动宣言有必要修改;现在,按照 Sub Articles(1)和埃塞俄比亚联邦民主共和国宪法“第 5

5、5条第(3)条规定,现宣布为如下;1、 简明目录本公告可引称为“劳动(修订)宣告 NO.494/2006”2、修正内容劳动公告 NO.377/2003现修改为如下:1/ 劳动公告 NO.377/2003的第 3 2)(c)条规定删除, 取而代之的是新规定的第3 2) (c)条规定(2)根据法律去落实和执行管理制度的管理雇员,或者是根据企业工作性质,拥有或者不拥有上述权利的、被授权去对雇员进行雇佣、调换、推迟、停职、指派或执行纪律的个人,还包括给雇主根据雇主利益给提is vested with the power to hire, transfer, suspend, layoff assign

7、)of Article 39 :“g) where he has no entitlement to a provident fund or pension right and his contract of employment is terminated upon attainment of retirement age stipulated in the pension law;h) where he has given service to the employer for a minimum of five years and his contract of employment i

8、s terminated because of his sickness or death or his contract of employment is terminated on his own initiative provided that he has no contractual obligation, relating to training, to serve more with the employer ”i) where is contract of employment is terminated on his own initiative become of HIV/

9、AIDS.3/ Sub-Article(6) of Article 130 is deleted and replaced by the following new Sub-Article(6):“6) parties to a collective agreement shall commence negotiation to amend or replace their collective agreement within 3 months before the expiry date of the validity period of the collective agreement;

10、 provided however, that if the negotiation is not finalized within 3 months from the expiry date of the collective agreement relating to wages and other benefits shall cease to be effective.”4/ Article 185 is deleted and replaced by the following new Article 185:供管理措施建议的法律服务的主要负责人。2/ 下面的新规定(g) (h) (

11、i)都添加在劳动公告 NO.377/2003的第 39 1)条的规定里(g) 没有享有公积金或退休金权利的和雇佣合约终止后达到退休年龄但没有养老金的(h) 雇员已经向雇主提供的服务至少五年,雇佣合约终止是因为雇员自己有疾病或死亡或因为,如果他没有合同义务为雇主提供更多的服务,且出于培训的相关原因而主动终止雇佣合同(i)因雇员患上艾滋病毒/艾滋病而主动终止雇佣合同3/劳动公告 NO.377/2003的第 130 (6)条规定被删除并替换成下面(6)的新规定:6)在集体协议的有效期届满日期前 3个月内,集体协议的各方应谈判出是否修改或取代他们的集体协议;然而,如果谈判没有最终确定,有关工资及其他福

12、利的集体协议在到期日 3个月内将不再是有效的。4/ 劳动公告 NO.377/2003的第 185 条被删除,取而代之的是新的 185条:“ 185. Common offences1/ An employer, a trade union, a worker or representative of employer which:a) Violates the provisions of this Proclamation, or regulations or directives issued hereunder relating to the safety of workers and c

13、ommit an act which expose the life or health of a worker to a serious danger, or does not give special protection to women workers or young workers as provided for in this Proclamation;b) contravenes the provisions of Article 160 of this Proclamation;c) Does not comply with the order given by a labo

14、ur inspector in accordance with this Proclamation or the provisions of other laws; ord) Gives intentionally false information or explanations to the competent authorities;Shall be liable to a fine not exceeding Birr 1,2002/ An employer, a trade union, a worker or representative of employer which con

15、travenes Sub-Article(2) or (4) of Article 130 of this Proclamation shall be liable to a fine not exceeding Birr 10,0003. 18、ONWHEREAS, it is essential that worker-em-ployer relations are governed by the basic Principle of rights and obligations with a view to enabling workers and employers to maintain Industrial peace and work in the spirit of harmony cooperation towards the all-round development Of our country;WHEREAS,

19、it has been found necessary to guarantee the right of workers and employers to form their respective associations and to engage, through their lawful elected representatives, In collective bargaining , as well as to lay down the procedure for the expeditious settlement of labour disputes, which aris

20、e between workers and employers;WHEREAS, it is necessary to strengthen and define by law the powers and duties of the organ charge with the responsibility of inspecting, in accordance with the law, labour administration, particularly labour conditions, occupational safety, health and work environmen

21、t;WHEREAS, it has been found necessary to revise the existing labour law providing for the basic principles which govern worker-employer relations and for labour conditions taking into account the political, economic and social policies of the government and in conformity with the international conv

22、entions and other legal commitments to which Ethiopia is a party with a view to translating into practice the objectives referred to above;NOW, THEREFORE, in accordance with sub-article 1 and 3 of article 55 of the constitution of the federal democratic republic of Ethiopia, it is hereby proclaimed

23、as follows:2003年第 377号宣言劳动宣言鉴于,在我们国家的发展建设过程中,为了使工人与雇主之间在协调与合作的精神下和平工作,需要一些基本法则来规定工人与雇主之间的权利与义务;鉴于,为了使工人与雇主之间相互尊敬、为了使双方有法可依、以及为了有据可循的解决雇主与工人之间的争端,有必要明确雇主与工人的权利;根据法律,劳动管理部门,尤其是劳动条件、岗位安全、健康和工作环境,有必要通过法律来加强责任监察部门的权利与义务。为了雇主和工人之间的关系,为了纳入政治、经济和社会制度范畴的劳动条件,为了与国际社会惯例以及其他埃塞俄比亚加入的组织惯例接轨,有必要修改现有的劳动法。现在根据埃塞俄比亚联

24、邦共和国宪法第55条款第 3条第 1项规定,做出宣言如下:PARTONE GENERAL1. Short TitleThis proclamation may be cited as the labour proclamation no. 377/2003.2. DefinitionsIn this proclamation:1)employer means a person or an undertaking who employs one or more persons in accordance with article 4 of this proclamation;2)undertak

25、ing means any entity established under a united management for the purpose of carrying on any commercial, industrial, agricultural, construction or any other lawful activity;Any branch carrying on the activities of an undertaking which is designated separately and which enjoys operational or organiz

26、ational autonomy shall be deemed to be a separate undertaking; 3) worker means a person who has an employment relationship with an employer in accordance with article 4 of this proclamation;4) minister or ministry means the minister or ministry of labour and social affairs respectively or bureau of

27、regional labour and social affairs.5) work rules means, subject to the provision of this proclamation and other relevant laws, an internal rules which govern working hours, rest period, payment of wages and the methods of measuring work done, maintenance of safety and the prevention of accidents, di

28、sciplinary measures and its implementation as well as other conditions of work;6)conditions of work means the entire field of relations between workers and employers and shall also include hours of work, wage, leave, payments due to dismissal, workers health and safety, compensation to victims of em

29、ployment injure, dismissal because of redundancy, grievance procedure and any other similar matters.7) region means any region as per article 47 of 第一部分 概述1. 简称本宣言命名为“第 377/2003.号劳动宣言”2. 定义在本宣言中:1) “雇主”指根据本宣言第 4条款规定,雇佣一个或者多个工作人员的企业或者个人2) “企业”指以商业、工业、农业、建设或其他合法行为为目的而建立的实体。任何单独享有组织、运行权利的企业分支将被视为一个单独的企

31、lic of Ethiopia. For the purpose of this proclamation it also include Addis Ababa and dire Dawa administration. 3. Scope of application 1) Without prejudice to sub-article (2) of this article, this proclamation shall be applicable to employment relation based on a contract of employment that exist b

32、etween a worker and an employer.2) This proclamation shall not be applicable to the following employment relations arising out of a contract of employment:a) Contracts for the purpose of upbringing, treatment, care or rehabilitation;b) Contracts for the purpose of educating or training other than ap

33、prentice;c) Managerial employee who is vested with powers to lay down and execute management policies by law or by the delegation of the employer depending on the type of activities of the undertaking with or without the aforementioned powers and individual who is vested with the power to hire, tran

34、sfer, suspend, layoff, assign or take disciplinary measures against employees and include professionals who recommend measures to be taken by the employer regarding managerial issues by using his independent judgement in the interest of the employer;d) Contracts of personal service for non-profit ma

35、king purposes;e) Contracts relating to persons such as members of the armed force, members of the police force, employees of state administration, judges of courts of law, prosecutors and other whose employment relationship is governed by special laws;f) Contracts relating to a person who performs a

38、thiopia is a signatory provides otherwise, employment relation between Ethiopian citizens and foreign diplomatic missions or international organizations operating within the territory of Ethiopia shall be governed by this proclamation;(b) The council of ministers may, by regulations, determine the i

39、napplicability of this proclamation on employment relations established by religious or charitable organizations:(c) The council of ministers shall issue regulation governing conditions of work applicable to personal services. 3、尽管第 3(1)条款相关规定:(a) 除非内阁根据规定做出决定,或者埃塞俄比亚签字的国际协议有规定,否则,埃塞俄比亚公民与在埃塞俄比亚境内活动的国外使团或者国际组织签订的协议受本宣言制约。 b) 内阁可以通过规定决定,基于宗教和慈善组织建立的雇佣关系不受本宣言制约。c) 内阁可以颁布规定来规范个人服务工作条件。
